Just the mention of a collection agency strikes fear in the hearts of the masses.<br/><br/>But, you have something the collector wants. They are basically begging you to pay. So if you get the image of a beggar calling you to ask for money in your mind, the collection agent doesn&#8217;t seem so intimidating. I certainly don&#8217;t want to down play the seriousness of the situation. They do have recourse, and it can be dire. But the fact is that the process is slow.<br/><br/>You can get them to give you the deal you want. You have to be firm, professional and show some fortitude. They are always going to tell you no. Relax, take a deep breath.<br/><br/>I really want to encourage you to NEVER talk to a collector on the telephone. First, most people can collect their thoughts a little better in a letter. It gives you time to think and make rational, unemotional, unpressured decisions. Second, everything you do with the collection agency needs to be written. If you use the mail everything is documented and date stamped. They can&#8217;t dispute it.<br/><br/>Most collection agencies pay literally a few cents on the dollar for old debt. Depending on the age, 1-7 cents may be average. On debts that are out of statute, they have paid one cent or less on the dollar.<br/><br/>Start your negotiation at 25% or less. If you owe $1000, offer $200 or $250. Many will accept quickly because they are making money can close out the account.<br/><br/>If the collection agency has added &#8220;fees&#8221;, don&#8217;t include them in the negotiated amount. Only negotiate on the original amount of the debt. Don&#8217;t seem to eager. Don&#8217;t volunteer any information. Never give them your bank account number, your employer or that inevitable &#8220;other number to contact you at&#8221;. Credit card negotiation would be the next step for those have failed with attempting to consolidate your debt. If you are 3 months or more past due or cannot keep the monthly minimums of your card payments current.<br/><br/>Generally this works much the same as a debt settlement but usually only involves unsecured credit. The special nature of unsecured credit allows the debt settlement company to negotiate a pay off usually in the rang of 40-50% of the balance because in the event that a bankruptcy must be filed they run the risk of not getting anything back.<br/><br/>In this type of transaction when a settlement is reached the debt settlement company will make a one time payment to the creditor to satisfy the balance of the loan. <br />You then owe the debt negotiation company the amount of the pay off plus any fees that where agreed upon.<br/><br/>A draw back to this process is it can have a negative impact on your credit score and the fees may be high at some companies. Another option is to self arbitrate.<br/><br/>If you have all intentions and ability to pay your debt you may wish to contact your creditors yourself. This allows you to negotiate a lower interest rate or a more realistic repayment plan.<br/><br/>If you decide to take the self arbitrate route, you will want a written agreement between you and your lender or collector that makes note of the fact your settlement has been &#8216;paid as agreed&#8217; or &#8217;satisfied in full&#8217;.<br/><br/>Self-arbitration or working with a credit card debt negotiation program you can be beneficial and successful. 			<content:encoded><![CDATA[<p><br/><br/>When you are in conducting a credit card debt negotiation, its important to know that you are negotiating for a position of strength. The Credit card companies don&#8217;t want you to default. They make their money by receiving consistent payments from you. Payments that can go on for years and years.<br/><br/>You are the one in control. You have something that they want to get from you, your payment. If your polite, professional and firm, you will get what you want.<br/><br/>This is a serious situation. They do have the ability to instigate legal action. This is unlikely on smaller balances, but is always a possibility. I have seen balances as high as 15,000 dollars end up being charged off without legal action. I have also seen balances as low as $500 go to court after just a few calls. But even court action is a fairly slow process, and you have time to react and negotiate the debt before the court date.<br/><br/>First, you need to make sure that you communicate by mail. Don&#8217;t give the collector a &#8220;no way out&#8221; situation by telling them to never contact you again. You have them backed them into a corner where they have little recourse but legal action. Credit card debt negotiation involves a level of compromise.<br/><br/>Instead, tell them they can contact you only by mail. And that they can never contact you at work. You will need to draft a letter to this effect and send it to them by registered mail, return receipt. In fact, all future communication with the collector will be by registered mail. And you always want to make sure you have a file of the delivery receipts and a copy of the letter available so that they can&#8217;t dispute that it was mailed, and that they received it.<br/><br/>The problem with phone calls is that when you are involved in credit card debt negotiation, you need to have verification. If it wasn&#8217;t written, it wasn&#8217;t done because you have no way to prove it if you end up in court.<br/><br/>Begin your credit card debt negotiation at 20-25% of the original debt amount. The collection agency may have added on fees and charges that you should not include in the settlement amount. These fees just amount to the collection agency trying to make more money, and have nothing to do with the debt to be settled.<br/><br/>Since on the &#8220;secondary market&#8221; debt is traded at literally a few cents on the dollar, the collection agency is making plenty of money, even if they end up settling at 30 or 40% of the original debt.<br/><br/>Don&#8217;t sound to eager to settle. Be calm and collected. Don&#8217;t get angry, don&#8217;t show hesitation. One thing I really want to add is NEVER let them know that you have some specific reason for settling the debt. Many people make an effort to settle before applying for a home loan for instance. This information is none of the collectors business. If they find out that the reason you want to settle is so that you can buy a house, you will never get a settlement.<br/><br/>So, in review.<br/><br/>1. Never talk to a collector on the phone. Always use registered mail with a return delivery receipt.<br/><br/>2. Start your negotiation at 20 &#8211; 25% of the original loan amount.<br/><br/>3. Don&#8217;t include the collection agencies add on fees as a part of your credit card debt negotiation.<br/><br/>4. Be calm, educate yourself to the process so that you can speak from a position of knowledge.<br/><br/>Just be patient. And make a good deal. Soon, this will all be behind you. But, when it does happen to someone, it can feel as though it is the worst thing ever and that they are buried so far that they will never see any light. But this does not have to be true as there are many ways to go about fixing the problem including debt negotiation. What credit card debt negotiation does is take the debt you owe and either reduces the total amount that you owe or find a way to make it easier to pay it off.<br/><br/>Generally, when a credit account hits a collection agency, there is more room to work a debt negotiation plan. This means that if you owe a total of four thousand dollars, they may be willing to take a lump sum payment of two thousand dollars and call the debt paid off. This helps the company in that they are finally receiving money from the debtor and the debtor is helped by the reduced amount of debt. Credit card debt negotiation plans are often a win-win situation for both parties involved. And while it is true that there will be a small mark on your credit for paying less then the total due, the affect is much less then leaving the debt sit or filing bankruptcy.<br/><br/>What to Do<br/><br/>If you look at your card statement, you will see that your interest rate is listed on there in a spot that is easy to find. If your rate is over 10% then you have something you can use for negotiating credit card debt. These are arbitrary numbers set by the credit card company and you can use them when you are negotiating debt. As long as you always pay your principle you are fine. I had a friend that would call his credit card companies once a year and tell them that if they didn&#8217;t lower their interest rates he was paying the card off in full and canceling it. More often than not the rates got lowered. This also affects your monthly payment and can help you control your monthly debt.<br/><br/>The best and generally the cheapest way to go about tackling debt negotiation is to call each of your creditors yourself and explain your hardship. While not every single credit card company or collection agency will be able and willing to accept a deal, there is a good chance that one or even a few of those on your list that you owe will be willing to work with you. Even though you would love to see every creditor on your list cut your debt in half, the fact is, even if one or two were able to slice your debt in half, you will have been successful in your credit card debt negotiation.<br/><br/>If you are feeling that you are not outgoing enough or maybe you are just simply too scared or shy to contact your creditors, you may need the assistance of someone else. There are agencies that are dedicated in helping you with credit card debt negotiation and since it is their job, they may know a few tricks that you do not and this could make all the difference in getting it done.
